The Last Will and Testament of Nicholas BRODOCK
In the name of God Amen.
I Nicholas BRODOCK of Vienna in the County of Oneida and State of New York mindful of the uncertainty of life and being of sound and disposing mind and memory and understanding do hereby make publish and declare this my last will and testament as follows
First I give devise and bequeath unto my daughter Hannah LAM wife of Seelye J.LAM the premises and real estate now occupied by said Seelye J LAM and his family in the town of Vienna Containing about thirty seven acres of land more or less with the appurtenances being the premises and estate conveyed to me by William JOHNSON and Phidelia JOHNSON his wife by warranty deed bearing date August 6, 1841 the same to be and remain the sole separate and individual property of the said Hannah LAM to be subject to her direction and control and in no wise soever subject to the control direction or disposal of her said husband; but to be the property of the said Hannah and her heirs forever.
Second, I hereby will and direct that all my just debts and personal charges be paid by my Executors hereinafter named, out of my personal property as soon as may be after my death.
Third, I give devise and bequeath unto my beloved wife Eve BRODOCK one undivided third part of all the real estate and personal property I may be ? and ? at the time of my death in lien of Dower to be hers and at her disposal
Fourth I give devise and bequeath unto my daughter Polly PRUITS wife of Jacob P PRUITS the sum of two hundred dollars to be paid by my Executors herein after named to be paid within two years after my decease the same to be remain the sole separate and individual property of the said Pollu PRUITS and her children forever.
Fifth I give and bequeath unto my daughter Hannah LAM wife of said Seely J LAM the sum of one hundred dollars to be paid by my Executors hereinafter named within two years after my decease and to be the sole separate and individual property of the said Hannah LAM and subject to her disposal and control.
Sixth, I give and bequeath unto my daughter Sarah PERRY widow of Freeman PERRY deceased to the sum of two hundred dollars to be her sole separate and individual property and at her control and disposal the same to be paid to her by my execution hereinafter named within two years after my decease
Seventh, I hereby give and bequeath unto my daughter Caroline WILMOT wife of Luther WILMOT the sum of two hundred dollars to be paid to her within two years after my death by my Executors and the same to be her sole separate and individual property forever.
Eighth I give and bequeath unto my daughter Catharine LENT wife of Abram LENT the sum of two hundred dollars to be paid within two years after my death by my executors and to be her sole separate and individual property forever.
Ninth, The bequests and legacies above entitled and directed to be paid my daughter above respectively named as legatees I hereby will and direct to be paid to them respectively over and above the sums to be paid to them respectively under and by virtue of an agreement heretofore executed to me by my sons Geo. H. and Chancy BRODOCK.
Tenth I give and bequeath to my son in law Luther WILLMOT the sum of one hundred dollars to be paid by my Executors within two years after my death.
Eleventh I give and bequeath to my grandchildren Miles CANE and Chancey CANE children of my daughter Sarah PERRY the sum of fifty dollars each to be paid to them by my Executors when they respectively attain the age of twenty-one years.
Twelfth all the rest residing and remainder of my Estate real and personal I hereby give devise and bequeath unto my two sons George H BRODOCK and Chancey BRODOCK to be equally divided between them.
Thirteenth I hereby nominate constitute and appoint my sons Geo. H BRODOCK and Chancey BRODOCK Execution of this my last Will and Testament hereby revoking all former wills by me made.
In witness whereof I have hereunto set my seal and subscribed my name this twelfth day of June in the year of our Lord one thousand Eight hundred and fifty two.

At a Surrogate’s Court held at the Surrogate’s
Office in Rome in the county of Oneida on the 4th day of August AG 1857
before Henry M BURCHARD Esq. Surrogate of said county for the purpose of
proving and recording the Last Will and Testament of Nicholas BRODOCK late
of the town of Vienna in the county of Oneida deceased in pursuance of
Chapter Sixth title, first article first part second of the Revised Statutes
of the State of New York …..Nathaniel Halstead being duly sworn and examined
in open court testified that he was well acquainted with Nicholas BRODOCK
deceased and had been for the last 20 years immediately preceding his death:
that he died in the month of June last past at Vienna in the county of
Oneida which was his last place of residence at the time of his death…
