The last will and testament of James
Innes. In the name of God Amen. I James Innes of the town
of Vienna in the County of Oneida and State of New York of the age of Seventy-five
years and being of sound mind and memory do
make, publish and declare this my last will
and testament in manner following that is to say.
First, I give and bequeath to my wife Mary
E. Horne Innes the farm I now own and on which I now reside, consisting
of fifty acres of land situate in the Town of Vienna said being a part
of Lot No. 65 in the 9th township of Scriba's Patent with all the ____
and all property of every name on nature that I may own at my decease to
have and to hold the same during her natural life if she remains my widow.
Second, I give and bequeath to my son
William Innes one-hundred and sixty dollars to be paid within one year
from the death of my said wife Mary E. Innes.
Third, all of the above named real and personal
estate bequeathed to my said wife shall at her death be equally divided
among my following named children ___: Catharine E. McDaniels, Jane
W. Youmans, Alexander H. Innes, Mary E.
Innes share and share alike.
And lastly, I do hereby nominate and appoint
Stephen Youmans to be the Executor of this my last will and testament hereby
revoking all former wills by me made. In witness where of I have
hereunto let my hand and seal this 10th day of September 1879
