The last will and Testament of Francis Rogers
of Western in the County of Oneida and State of New York.
I Francis Rogers considering the uncertainty
of this mortal life and being of sound mind and memory (?)Almighty God
for the
same do make and publish this my last Will
and Testament in manner and from following that is to say,
First I give and bequeath unto my children
James Rogers, John Rogers, Joseph Rogers, William Rogers, George Rogers,
Adam Rogers and Catherine wife of Peter Maccomber,
all of my estate both real and personal after deducting all my debts
financial expenses and after the sum of Three
Hundred dollars shall be paid by my son Adam Rogers on a Bond against him
to my daughter Jane Rogers as is expreped(?)
in said Bond the said property to be equally divided among my children
above
first named.
Second, I do hereby appoint my sons William
Rogers and James Rogers Executors of this my last will and testament hereby
revoking all former wills by ??

of us who have hereunto subscribed our names as witness in presence of

do hereby certify the foregoing to be the Record of the last will and
Testament of Francis rogers deceased and
of the proofs and examinations taken in the probate thereof.

I, Charles R. Rauck whose residence is number
168 Fayette Street, city of Utica, State of New York, being of sound and
disposing memory and a citizen of the State of New York, do make ordain
publish and declare this my last will and testament in manner following
that is to say.
First. I revoke all wills by me heretofore
made and direct that debts & funeral expenses be first paid.
Second. I give grant and bequeath unto my
wife Catharine Rauck in lieu of dower the sum of five hundred dollars,
to be paid and accepted in full of dower. If so accepted sum to be a lien
on my real estate until paid.
Third. I give and bequeath unto my grandson
Charles McLaughlin fifty dollars, and unto my daughter Hellen Young twenty
five dollars, and make sum a charge and lien on my real estate.
Fourth. I grant and bequeath unto my daughter
Dora Rauck my downstairs bedstead and bedding for same. I grant and bequeath
unto my son Charles R. Rauck of Buffalo N.Y. my gun, my revolver and all
my clothing. I grant and bequeath unto Frankie Hauck son of Theresa
Hauck my silver watch and chain.
I give and grant unto my granddaughter Hellen
Wiley my guitar and six chairs in front room.
Fifth. I give grant and bequeath unto my
grandchild Louisa Rauck twenty five dollars, and unto my grandchild Theresa
Rauck twenty five dollars and make same a lien and charge on my real estate.
Sixth. I give grant, devise and bequeath
all the rest and residue of my estate real and personal unto my children
Theresa Hauck, Dora Ribolin, Nettie Eise (of Buffalo N.Y.) And Charles
R. Rauck share and share alike.
Seventh. I do nominate constitute and appoint
Frank Sang and Phillip Hammes both of Utica N.Y. to be executors of this
my last will and testament and do authorize them to manage, lease, mortgage
or sell my real estate and do empower them and the survivor of them to
do whatever I might or could do if living to or for same and to give convey
over or deed therefor fully and completely.
In witness whereof I have hereunto subscribed
my name and put my seal at Utica State of New York this eleventh
day of March eighteen hundred and ninety six.

Be it remembered that on the 29th day of
November 1897, at a Surrogate's Court, held in and for the County
of oneida, the within Last Will of Charles R. Rauck late of the city of
Utica in said County, deceased, was upon due proof admitted to probated
as a will valid to pass real and personal property.
In Testimony whereof, I have hereunto set
my hand, and affixed the seal of said Court; at the City of Utica, on this
29th day of November A.D. 1897
